I often receive calls from people who have had car accidents and are already represented by other lawyers and want to know if they can fire their lawyer and come and have me handle the case. I tell them yes they can, but that’s not what they should do.

The first thing they should do is call their lawyer and immediately set up an appointment to see them. Tell your lawyer that you’re unhappy, what made you unhappy and that you called me to see if I would take over your case and that I told you to get back to your lawyer and to have a discussion with him.

I have found that very often your lawyer is doing right by you other than communicating that to you. Let your lawyer know what you expect to happen, what you want them to do to keep you happy and from that point on they should.

However, if your lawyer, after being specifically told about your unhappiness and your expectation doesn’t meet those needs you absolutely have the right to fire that attorney.
